פוסט אורח מאת עינת פודחרני, אשר מסביר כיצד פועלת החברה העירונית “חלמיש”, האחראית לספק עזרה בפתרונות דיור לשכבות הכי חלשות בחברה בתל-אביב וביפו. השידור הראשון שלנו התייחס למקרה הזה.

ביום שני, ה- 2.3.09, הגיעו כוחות משטרה לפנות את משפחת מ‘ מביתה. בבית מתגוררים האם וששת ילדיה - הקטנה בת שנתיים, הגדול בן 17 - אותם היא מגדלת לבדה. משפחת מ‘ נכנסה לדירה ממנה פונתה ביוני 2008, לאחר שהמתינה שנים ארוכות לקבלת דיור סוציאלי - לו היתה זכאית - מחברת חלמיש. לאחר ההמתנה הממושכת וקשיים גוברים בתשלום השכירות, החליטה המשפחה לפלוש לדירה הסמוכה למגוריה, השייכת לחלמיש, שעמדה ריקה כשנה שלמה.

הפינוי נדחה ליום רביעי, בעקבות התערבותו של חבר המועצה עומר סיכסק ופעילים מהוועדה העממית היפואית. ביום רביעי הגיעו לבית המשפחה עשרות פעילים, שנענו לקריאת הוועדה, ושהו במקום במשך כל היום. חברי המועצה סיכסק, אהרון מדואל ויואב גולדרינג הגיעו למקום, ושוחחו עם מנכ”ל חלמיש, גיל סער. למרות הלחצים, סירב המנכ”ל לדחות את הפינוי עד למציאת דירה חלופית למשפחה. סיכסק פנה ללשכת ראש העיר ישירות וביקש מרון חולדאי להתערב, אך לא נענה. נוכחות הפעילים הובילה לדחיית הפינוי לשעות הערב המאוחרות. הדחייה איפשרה חיפוש קדחתני והפעלת קשרים למציאת דירה חלופית עבור המשפחה. בשעות הערב נמצאה דירה ביפו - בשכירות גבוהה, אך היחידה שבעליה הסכימו לחתום על חוזה עם המשפחה, ועוד בפרק זמן כה קצר.

בעת החתימה על החוזה, הגיעו מפנים לדירה בליווי שוטרים ויס”מ, ועימם נציגי חלמיש, והחלו לפנות את תכולתה. המפנים סירבו להיענות לבקשת הפעילים להמתין עד חזרת בעלת הבית למקום. בסוף היום נחתם חוזה שכירות ואף התקבלו המפתחות, ולאחר מכן הועברו חפצי המשפחה לדירה החדשה. בעקבות ההתגייסות של האמורים לעיל, המשפחה ניצלה הפעם מהוצאתם לרחוב, אך בעיית השיכון של המשפחה רחוקה עדיין מפתרון.

הסיטואציה אליה נקלעה משפחת מ‘ מהווה מקרה בוחן, אחד מיני רבים, המשקף מדיניות של השלת האחריות של המדינה מתושביה ומזכותם לדיור.כעת עלינו לפעול למציאת פתרון הולם מבחינה כלכלית (ופוליטית) למשפחה, אך לפחות הם אינם מתגוררים ברחוב.

הרקע לאירועים - איך זה קורה

משפחת מ‘ נכנסה לדירה ממנה פונתה ביוני 2008. לאחר המתנה של שנים לקבלת דיור סוציאלי - לו היתה זכאית - מחברת חלמיש, החליטה המשפחה לפלוש לדירת חלמיש, שעמדה ריקה כשנה שלמה. חלמיש - חברה ממשלתית שתפקידה לטפל במשפחות זכאיות לדיור סוציאלי - הגיבה הפעם במהירות, וביקשה לפנות את המשפחה מהדירה. בליווי הוועדה העממית ובאמצעות עו”ד רשא עסאף הגישה המשפחה בקשה נוספת לתעודת זכאות, ובפברואר השנה קיבלה את האישור, הכולל סיוע בשכר דירה, במסגרת הסכם עם חלמיש.

הוועדה העליונה של חלמיש דנה בבקשתה של משפחת מ‘ לסיוע בשכר דירה בשלישי בפברואר, והחליטה לאשר לה סיוע בסך של 1,200 שקלים לחודש, בהתחשב בגודל המשפחה והכנסותיה. הפעילה יהודית אילני מסיעת יאפא קיבלה אישור בשיחת טלפון עם מנהל האיכלוס של חלמיש, אלי שחר, שהמשפחה תקבל סיוע של חודש מראש, עוד טרם עזיבת הדירה אליה פלשה, כדי שתוכל לעבור בינתיים לדירה אחרת.

מיותר לציין כי סיוע בהיקף של 1,200 שקלים לחודש אינו תואם את מחירי השכירות ביפו, ועל כן מציאת דירה הולמת במחיר סביר דורשת פעילות בקרב הקהילה וחיפוש אחר תומכים או בעלי דירות שמוכנים לבוא לעזרת המשפחה, דבר שלוקח זמן, ואינו מהווה פתרון אמיתי ארוך טווח.

אין זה מקרה שחלמיש מעדיפה לאשר סיוע לא מספק בשכר דירה על פני המשך מגורים בדירה הנוכחית או בדירה חלופית. חלמיש מקדמת מדיניות המעבירה את האחריות לבעלי הזכאות, ופוטרת את עצמה דרך הענקת סיוע שאינו מאפשר בפועל המשך מגורים בתל-אביב יפו. באופן זה נאלצות המשפחות לעבור לגור בערים אחרות, וחלמיש לכאורה ביצעה את תפקידה.

המקרה הפרטי של משפחת מ‘ היה מקרה בהול, שדרש פתרון מיידי. עם זאת, מקרה זה משקף בעיה מתגברת, עימה מתמודדות מאות משפחות ביפו. לפי נתוני חלמיש, קיימות ביפו 200 משפחות בסטטוס המתנה דומה לזה של משפחת מ‘. לטענת חלמיש, אין בידיה מספיק יחידות דיור כדי לאכלס את המשפחות, והמדינה אינה רוכשת או בונה דירות נוספות, אלא דווקא מוכרת את הקיימות כחלק מתהליך של הפרטה. בנוסף, ממשיכה המדינה למכור נכסי נפקדים, להכניס מיליוני דולרים לקופתה, ולא להשקיע אותם בחזרה באוכלוסייה המקומית, המבקשת לחיות בכבוד בעיר בה נולדה וגדלה.

לאחרונה, הגישה הוועדה העממית בקשת מידע בעזרת חבר המועצה אהרון מדואל לחלמיש, בה היא מבקשת דיווח על מספר הדירות בבעלות חלמיש בתל-אביב יפו ומספר הדירות המאוכלסות כיום. בקשת המידע הוגשה לאחר קשיים ניכרים בקבלת מידע זה מחלמיש, וטרם נענתה.

במקרה אחר אותו ליוותה הועדה העממית פונתה משפחה מביתה בעג’מי לדירה חלופית בטענה כי “הבית גדול מדי, ויש משפחות גדולות הממתינות בתור”. לאחר פינוי המשפחה, הוצאה הדירה למכרז פתוח ונמכרה לידיים פרטיות. כתושבי העיר עלינו לדרוש מחברת חלמיש לפעול לטובת הציבור אותו היא מחויבת לשרת כחברה עירונית, ולא לטובת רווחים מהירים תוך השלת אחריותה כלפי לקוחותיה, תושבי העיר הזכאים לתמיכתה.

رسالة من مدونة عنات فودخارني، والذي يشرح كيف تعمل الشركة البلدية “حلاميش”، المسؤولة عن تزويد الطبقات الاكثر ضعفا في تل ابيب – يافا بحلول للسكن.

يوم الاثنين الموافق 2.3.09، وصلت قوات من الشرطة لاخلاء بيت عائلة “م”. يسكن في هذا البيت الام وستة اولادها – الصغيرة بينهم في عمر السنتين، والكبير ابن السابعة عشرة – والذين تربيهم الام لوحدها. دخلت عائلة “م” الى الشقة التي تم اخلائها منها في يونيو (حزيران) 2008، بعد انتظار دام سنوات طوال للحصول على سكن حكومي – هي مؤهلة له – من شركة حلاميش. بعد الانتظار المتواصل والصعوبات المتزايدة في دفع الايجارات، قررت العائلة ان تقتحم الشقة القريبة منها، والتابعة لحلاميش، والتي لم تكن مسكونة منذ سنة كاملة.

تم تأجيل الاخلاء ليوم الاربعاء بعد تدخل عضو البلدية عمر سكسك ونشطاء من اللجنة الشعبية اليافية. وفي يوم الاربعاء وصل الى بيت العائلة عشرات النشطاء الذين استجابوا لدعوة اللجنة، وقضوا كل اليوم بالمكان. اعضاء البلدية سكسك، اهرون مدوّل ويوآف جولدرينج وصلوا الى المكان وتحدثوا الى مدير حلاميش، جيل ساعر. وبالرغم من الضغوطات رفض المدير ان يتم تأجيل الاخلاء لوقت تجد فيه العائلة شقة بديلة. توجه سكسك الى مكتب رئيس البلدية مباشرة وطلب من رون خولدائي ان يتدخل ولكنه لم يستجيب. وجود النشطاء اجّل اخلاء البيت لساعات المساء المتأخرة. والتأخير مكّن من اتمام بحث محموم وتشغيل علاقات من اجل ايجاد شقة بديلة للعائلة. في ساعات المساء تم ايجاد شقة في يافا – بايجار باهظ، ولكنها الشقة الوحيدة التي وافق اصحابها على توقيع عقد مع العائلة، وبوقت جد قصير كهذا.

خلال التوقيع على العقد، وصل المخلون الى الشقة بصحبة الشرطة وقوات الوحدات الخاصة، ومعهم مندوبين عن حلاميش وبدأوا باخلاء البيت من محتوياته. لقد رفض المخلون طلب النشطاء بالانتظار حتى يعود اصحاب البيت الى المكان. في نهاية اليوم تم توقيع عقد ايجار، بل حتى الحصول على المفاتيح، ومن بعدها تم نقل أمتعة العائلة الى الشقة الجديدة. خلفا لتطوع المذكورين اعلاه وتجندهم للموضوع، نجت العائلة هذه المرة من اخراجها للشارع، ولكن اشكالية مسكن العائلة ما زال بعيدا عن ايجاد حلا مناسبا.

الحالة التي وقعت فيها عائلة “م” تمثل حالة مجهريّة، واحدة من الكثيرات، والتي تعكس تراجع الدولة عن مسؤولياتها تجاه مواطنيها وحقهم بالسكن. الان علينا ان نعمل لايجاد حل ملائم للعائلة من الناحية الاقتصادية (والسياسية). الان، على الاقل، هم لا يعيشون في الشارع.

الخلفية للاحداث – كيف حدث هذا

لقد دخلت عائلة “م” الى الشقة التي تم اخلاؤها منها في يونيو (حزيران) 2008. وبعد انتظار سنوات للحصول على سكن حكومي – تستوفي العائلة شروطه وتستحقه – من شركة حلاميش، قررت العائلة ان تقتحم شقة تابعة لحلاميش، والتي كانت مهجورة لمدة عام. حلاميش – شركة حكومية والتي من دورها ان تعتني بالعائلات التي يحق لها الحصول سكن حكومي – ردت هذه المرة بسرعة، وسارعت لاخلاء العائلة من الشقة. بمرافقة اللجنة الشعبية ومحامية اللجنة رشا عسّاف قدمت العائلة طلب اضافي لشهادة تزكية (استحقاق سكن اجتماعي)، وفي شهر فبراير (شباط) السنة حصلت على الموافقة، والذي يشمل مساعدة بدفع الايجار، في اطار اتفاق مع حلاميش.

اللجنة العليا لحلاميش تباحثت في الثالث من فبراير (شباط)، في طلب عائلة “م” لمساعدتها بدفع ايجار الشقة، وقررت ان تمنحها مساعدة شهرية بقدر 1200 شاقل جديد، اخذا بعين الاعتبار كِبر العائلة ومدخولها. لقد حصلت الناشطة يهوديت ايلاني من قائمة “يافا” على موافقة تلفونية من مدير الإسكان في حلاميش، إيلي شاحر، مفادها ان العائلة ستحصل على المساعدة شهر سلفا، وقبل مغادرتها للمنزل الذي اقتحمته، من اجل ان يتثنى لها الانتقال الى شقة جديدة.

من غير الضروري الاشارة، ان مساعدة بقدر 1200 شاقل شهرية لا تتلائم واسعار الايجارات في يافا، ولهذا فان عملية ايجاد شقة مناسبة بسعر معقول بحاجة الى وقت طويل من اجل العمل بين الناس وبحث عن داعمين او اصحاب بيوت مستعدون لمساعدة العائلة، وكل هذا ليس بحل لمدة طويلة.

ليس صدفة ان حلاميش، تفّضل الموافقة على مساعدة مالية غير كافية باجر البيت على استمرار سكن العائلة في الشقة الحالية او اخرى بديلة. تقوم حلاميش بخطو خطوة للامام، وتشجيع سياسة تتحول فيها المسؤولية على اصحاب الاستحقاق، وتعفي حلاميش نفسها من خلال اعطاء مساعدة والتي لا تؤمن عمليا امكانية استمرار السكن في تل ابيب – يافا. بهذه الطريقة تضطر العائلات الى الانتقال الى مدن اخرى، وظاهريا تبدو حلاميش كمن قامت بدورها على اكمل وجه.

هذه الحالة الخاصة لعائلة “م” هي حالة ملحّة، وبحاجة الى حل فوري. ومع هذا، فهي تعكس مشكلة آخذة بالتعاظم، مشكلة تواجهها مئات العائلات في يافا. حسب معطيات حلاميش، توجد في يافا 200 عائلة في وضعية انتظار مشابهة لعائلة “م”. وحسب ادعاء حلاميش فهي لا تملك عددا كاف من الوحدات السكنية حتى يتم اسكان العائلات، والدولة لا تقوم بشراء او بناء شقق اضافية، بل على العكس تقوم ببيع الموجودات حاليا كجزء من حالة الخصخصة. زد على ذلك، ان الدولة مستمرة في بيع املاك الغائبين، وادخال ملايين الدولارات الى خزينتها، دون ان تستثمرهم بالسكان المحليين والذين يريدون العيش بكرامة في البلد التي ولدوا وتربوا بها.

قدمت اللجنة الشعبية مؤخرا استجواب لشركة حلاميش عن طريق عضو البلدية اهرون مدّول، طلبت فيه تقرير بعدد الشقق التي تملكها حلاميش بتل ابيب – يافا وعدد الشقق المأهولة من بينها. لقد تم تقديم هذا الطلب بعد مصاعب شتة واجهت اللجنة بالحصول على هذه المعلومات، ولم تتم الاستجابة بعد.

في حالة اخرى، رافقتها اللجنة الشعبية تم اخلاء عائلة من بيتها الواقع في العجمي الى شقة اخرى تحت مسوغ ان “البيت كبير جدا، وهناك عائلات كبيرة تنتظر بالدور”. بعد اخلاء العائلة، تم الاعلان عن بيع البيت في مزاد علني وبالفعل بيع البيت لافراد. كسكان في هذه المدينة علينا مطالبة حلاميش بالعمل من اجل خدمة الجمهور الذي التزمت لخدمته كشركة بلدية، وليس من اجل الحصول على ارباح سريعة بينما تقوم بالتخلي عن مسؤوليتها تجاه زبائنها، سكان المدينة الذين هم بحاجة الى دعمها.

The following guest post explains the actions of Halamish, a municipal company mandated with supplying housing aid for the weakest residents of Tel-Aviv-Jaffa.  Halamish and the story of M.’s,  a single  mother  six children, eviction was referred to in our first broadcast.

On Monday, March 3rd, 2009, police forces arrived at M. family’s Jaffa apartment to evict them from the premises. A single-parent family, the M.’s consist of a mother and six children – the youngest two years old, the oldest seventeen. The family had entered the apartment in June of 2008 after waiting for many years for welfare housing it was eligible to through Halamish, the municipal housing also responsible for families eligible for welfare housing benefits. The waiting period drew longer and longer and the family struggled to make payments on the lease. It finally decided to invade an adjacent apartment, also owned by Halamish, which had stood vacant for about a year beforehand.

The intervention in the case by Tel-Aviv-Jaffa Municipal Councilman Omar Siksak and several activists of Jaffa Popular Committee led to a two-day stay of the family’s evacuation, until the Wednesday after. Heeding the Committee’s call, dozens of activists arrived on the premises on that day, spending the entire day with the family. Councilmen Siksak, Aharon Maduel and Yoav Goldring also arrived on site, and spoke to Halamish Director-General Gil Sa’ar. Despite all their efforts, however, Sa’ar refused to further postpone the family’s evacuation to a time when the family was awarded an alternative housing solution. Siksak went so far as to directly approach the Office of the Mayor of Tel-Aviv-Jaffa and demanding to speak personally with Mayor Ron Huldai, but his demands were unanswered. The activists’ presence on the premises was however instrumental in staying the family’s evacuation to later Wednesday evening, and this led to a feverish search for alternative housing.
The activists managed to locate an exorbitantly-priced apartment in Jaffa, the owners of which were the only ones who would sign a lease with the family on such short notice.

However, even while the lease was being signed, several evictors, accompanied by police officers and Special Patrol Unit officers, arrived at M. family’s apartment and began emptying out its contents. They refused to acquiesce to activists’ requests to wait at least until the inhabitants returned home to collect their belongings. The day ended with the lease signed, the keys of the new apartment exchanged and the family’s belongings’ transferred there. But even though the presence of activists on the premises meant that the family was spared the humiliation of being thrown out on the street, their housing difficulties are far from being resolved.

The situation that M. family found itself in is a test case – one of many – which reflects a deliberate policy of divestment by a municipal company accountable to the residents and their housing rights. At present, an economically and politically viable solution for the family’s difficulties is yet to be found, but at least they are not living on the street.

Background – How This Happens

As mentioned above, the family had entered the apartment from which it was later evacuated in June of 2008 after a many-year-long wait for welfare housing it was entitled to through Halamish. The waiting period drew longer and longer and the family struggled to make payments on the lease. It finally decided to invade an adjacent apartment, also owned by Halamish, which had stood vacant for about a year beforehand.

The family lodged another application for housing benefits (which include rent aid in the context of an agreement with Halamish), and was accompanied this time by Attorney Rasha Assaf and the activists of the Jaffa Popular Committee. Their application was approved in February of 2009.

Halamish’s board debated the family’s application for rent aid on February 3rd and ruled to allocate it a monthly sum of NIS 1,200 in rent aid because of its size and income. Yehudit Ilani, a member of the Yaffa municipal council faction, in fact received oral confirmation in a phone call from Eli Shahar, who manages the company’s housing policies that it would grant the family said aid one month before it was to leave the apartment it had invaded in order to help it in its relocation efforts. It bears mentioning that an aid package to the tune of NIS1,200 does not begin to match rent rates in Jaffa. This means that a community effort will be needed just to find the family a suitable apartment at a reasonable price.

Halamish’s policy – its predilection of approving unsatisfactory rent aid as well as its discontinuation of the family’s current housing situation – must by no means be construed as accidental. The company is in fact actively pursuing a policy of abdicating its responsibility toward families eligible to welfare housing, in so doing spelling in effect their relocation to other towns. At the same time, Halamish portrays itself as having performed its duties.

The private case of the M. family was an urgent case that demanded immediate resolution. This case, however, reflects a growing problem that hundreds of Jaffa families have to deal with. According to data collected by Halamish itself, 200 more Jaffa families are living under the same conditions. Halamish claims that it has an insufficient number of housing units with which to house all of them – but has, instead of purchasing or building new ones in fact sold off existing units as part of its ongoing privatization efforts. Furthermore, the establishment continues its policy of selling off “absentee property”(1) to the tune of millions of shekels, and never invests them back in the local population, whose only wish is to lead a life of dignity in its place of birth.

The Popular Committee, through councilman Maduel, has recently lodged a request with Halamish for detailed accounts of its Tel-Aviv-Jaffa apartments, as well as the percentage of those occupied. This was done after Halamish raised numerous obstacles in the committee’s path to information. It is remains unanswered.

In one case which the Popular Committee oversaw, a family was evacuated from its home on the Ajami neighborhood of Jaffa, with Halamish claiming the house was too big for the families’ need and that larger families were waiting in line for it. After it was evacuated, the apartment was put up for open auction and sold to private owners. As residents of this city, we demand that Halamish – a municipal company – act to benefit the public it is mandated to served, and not to make a fast buck while abdicating all responsibility.

A group of ordinances incorporated into Israeli law in and around the 1948 war, the so-called Absentee Property Law classifies people who were citizens of the neighboring Arab states (considered ‘enemy states’) during the war, and who left their places of residence from within Israel/Palestine for whatever reason during it, as ‘absentees’. Under it, absentees’ properties were vested in the custodian of absentee property, who then sold them to development authorities empowered by the Knesset (the Israeli parliament). This legal framework has historically allowed the transferal of Palestinian property into Jewish hands – in Jaffa as in other places throughout the state.
